This week, we are spotlighting the EB-5 Investor Visa, a unique immigration option that allows foreign investors to obtain permanent residency in the United States while directly contributing to the U.S. economy. For entrepreneurs and investors seeking new opportunities, the EB-5 visa provides both a pathway to a green card and a chance to create meaningful economic impact.

What Is the EB-5 Visa? The EB-5 visa is an employment-based, fifth-preference immigrant visa designed to attract foreign capital into the United States and create American jobs. Through qualified investments, foreign nationals and their families can secure lawful permanent residency.

Eligibility RequirementsTo qualify for the EB-5 visa, applicants must:
  • Make a qualifying investment of at least $1,050,000 in a new commercial enterprise.
  • Alternatively, invest a reduced amount of $800,000 if the project is located in a Targeted Employment Area (TEA), which includes rural areas or regions with high unemployment.
  • Create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years of the immigrant investor’s admission to the United States as a conditional permanent resident.
  • Provide lawful source of funds documentation to show the investment capital was obtained legally.

Direct Investment vs. Regional CentersThere are two primary paths under the EB-5 program:
  1. Direct Investment: The investor directly creates and manages a business that generates the required jobs.
  2. Regional Center Program: Investors pool resources in government-approved regional centers, which manage the enterprise and track job creation. This option is often attractive to those who prefer a more passive role.

Benefits of the EB-5 Visa
  • Direct Path to a Green Card: Investors, their spouses, and unmarried children under 21 can all receive permanent residency.
  • No Employer Sponsorship Needed: Unlike many employment-based visas, EB-5 does not require a job offer or employer petition.
  • Geographic Flexibility: Investors can live anywhere in the U.S., regardless of where their investment is located.
  • Contribution to U.S. Growth: EB-5 investors directly help stimulate economic development and job creation.

The Petition ProcessThe EB-5 process typically involves:
  1. Filing Form I-526 (Immigrant Petition by Alien Investor).
  2. Upon approval, applying for conditional permanent residence (green card valid for two years).
  3. After two years, filing Form I-829 to remove conditions by proving the investment created the required jobs.

Why the EB-5 Visa MattersThe EB-5 program is more than an immigration pathway—it is a driver of growth in industries such as real estate, infrastructure, technology, and community development. By bringing in foreign investment, the program not only supports local economies but also strengthens the overall U.S. job market.
At Stommes Immigration, we guide investors through the EB-5 process, from documenting lawful sources of funds to preparing comprehensive petitions. Whether you are an entrepreneur seeking to grow in the United States or an investor aiming to secure a future for your family, the EB-5 visa offers a bridge between opportunity and permanent residency.
